& held for the County of Wayne at the Court house in the town of Waynesboro on the
first day it being the first Monday in July in the year of our Lord one Thousand eight
hundred and fifty the following Justices of the peace present and presiding (to wit) D J
JONES Chr. YOUNG LAFFERTY JOBE CARTER BURNS MONTAGUE BARKER WILSON VOORHIES GANT WALTKINS

Came J P VOORHIES & others who was at a former term of this court appointed a Jury of
View to view and mark out so as to change the road leading up Buffalo River and make the
following report Begin at David VOORHIES and runne [sic] to John CRAIGs which report was
[Ordered-crossed out] received by the Court and ordered to be recorded
Ordered by the Court that E POLLACK be appointed Overseer of the opening and Keeping up
the road as viewed and marked out by J P VOORHIES & others and that he have the
following hands George I WALKER Samuel VOORHIES David VOORHIES hands James VOORHIES George
W PERY James McCAN Solom COUCH, and all the hands in the bounds to work under his
direction Isued July 25th 1850
A settlement between Wm JONES Clerk of this Court and John N MARTIN Guardian of the minor
heirs of Nathaniel MARTIN dec'd was this day submitted to the Court which was received by
the Court & ordered to be recorded
Ordered by the Court Jonathan MORRIS James ANDERSON & John McDOUGAL be appointed a
committee to superintend the Painting outside the wood work [Window Casing - crossed out]
&c of the Court house in Waynesboro
Came James ANDERSON Administrator of the Estate of Jesse COPELAND Dec'd and returned into
court an Inventory of said Estate verified by his oath which was received and ordered to
be recorded
Came James ANDERSON Administrator of all and singular the googs[sic] & Chattles rights
& credits of the estate of Elizabeth LOYD dec'd and returned into Court an Inventory
of said Estate verified by his oath which was received and ordered to be recorded
Came T H MABRY Trustee of Wayne County and entered into bond in the sum of Twenty six
hundred dollars with C B McLEAN Jon. MORRIS & J L CYPERT his securities Condition for
the faithful paying out all monies that shall come into his hands on account of Common
School which was received by the Court and ordered to be recorded

Upon motion to appropriate to John McDOUGAL & others entitled thereto the sum of
fifteen 50/100 [twenty one 25/100 [ - crossed out] dollars in a bill of cost against Wayne

Supreme Court five 75/100 dollars Clerk John McDOUGAL five 75/100 dollars Sheriff PUGH
four dollars those who voted in the affirmative were D J JONES Chr. YOUNG LAFFERTY CARTER

Upon motion to appropriate to Jonathan MORRIS the sum of twelve dollars and fifty three
cents the amount by him expended for BOYD a pauper of said County Those who voted in the

This day Matthew J SIMS presented to the Court his resignation to the office of Justice of
the peace of the eight civil district Wayne County in writing which was received by the
Court and ordered to be recorded
Notice was this day given to the Court by Katherine COPELAND widow of Jesse COPELAND Dec'd
that she will apply at the August term of this court to have two freeholders appointed to
apportion her dower
Ordered by the Court that Joseph HAM be appointed overseer of the road of 2d Class in the
place of G R BIFFLE and that he have the hands in the same bounds to work under his
direction Isued July 25th 1850
Came James ANDERSON who was at a former term of this Court appointed Administrator of all
and singular the goods & Chattles rights and credits of Jesse COPELAND dec'd and
suggested in writing the Insolvency of said estate it is therefore ordered by the Court
that such publication be given as in by law in such cases required and that notice be
given to all person having Claims against said estate to file them with the Clerk of this
Court by the first day of January net duly authenticated as the law directs for prorate
distribution[sic] or they will be forever barred
Came Joseph HOLT & others who was at a former term of this Cort[sic] appointed a Jury
to view so as to change the Waynesboro & Florence Road by the plantation of Samuel
LAWSON and report a change as directed in the order which was received by the Court and
ordered to by[sic] recorded

Came Daniel PHILIPS & others who was at a former term of this Court appointed a Jury
of View to view & mark out so as to Change the road running dow[sic] little Cypress
Commencing opposite George WHITTEN's and report a change made as directed in the said
order which was received and ordered to be recorded
A settlement between Wm JONES Clerk of this Court and T.H. MABRY Trustee of said County of
the apportionment and distribution of the Common School monies in the year 1849 was this
day submitted to the Court which was received and ordered to be recorded
Ordered by the court that Samuel BECKHAM be appointed overseer of the road of 2d Class in
the place of John MELSON and that he have Wm ETHRIDGE John MELSON & John ROBINS and
all the hands in that bounds to work under his direction Isued July 25th 1850
Came Elizabeth CARTER who has been constituted and appointed Guardian to Soloman K CARTER
Joseph W CARTER John R CARTER & George J CARTER minor heirs of David CARTER Dec'd and
entered into bond in the sum of fifty one hundred and sixty dollars with Daniel T CARTER
and Rutha M CARTER her securities which was approved by the Court and ordered to be
recorded

A settlement between Wm JONES Clerk of this Court and Elizabeth CARTER Guardian to the
minor heirs of David CARTER dec'd was this day submitted to the Court which was confirmed
and ordered to be recorded.
Came D.J. JONES Guardian to [the minor heirs of George V-crossed out] Giles VINSANT minor
heir of George VINSAND dec'd and renewed his bond in the sum of one hundred and fifty
Dollars with C B McLEAN his security which was approved of by the Court and ordered to be
recorded
Ordered by the Court that C H HUGHLING be appointed overseer of the road of 2d Class and
that he work from the Waynesboro & Savannah road, the Eastport Road to the Eight mile
tree & that he have Joseph HUGHLING Alison HUGHLING Thomas ARNOLD Longrun[?] MORRIS
Hazle COPELAND and all the hands in that bounds to work under his direction Isued Aug. 5th
1850
Came C B McLEAN in to Court who has been chosen and appointed Administrator upon all and
singular the goods & Chattles rights & Credits of Henry GRIMES deceased and
entered into bond in the sum of thirty hundred dollars with John McDOUGAL and W W GRIMES
his securities Conditioned for the faithful performance of his said Administrationship
which was received by the Court and ordered to be recorded Whereupon the said McLEAN took
the necessary Oath for his qualification
Came Thomas P CYPERT who was on the 15th day of July last duly and legally Elected Justice
of the peace for said County by the qualified Voters of the 8th Civil district thereof and
presented to the Court his Commission whereupon the said T P CYPERT took the necessary
oaths for this qualification
Came James C WHITAKER who was duly elected a Justice of the peace of Wayne County by the
qualified Voter[sic] of the 3rd Civil district thereof and presented to the Court his
Commission whereupon the said J C WHITAKER took the necessary oaths for this qualification

Ordered by the Court that Jonathan MORRIS [ Jonathan I BIFFLE and - crossed out] John
McDOUGAL and Joseph EAST be appointed Commissioners to allot and set apart to Mary Ann
Elizabeth GRIMES minor heir of Henry GRIMES deceased so much of the Crop stock provision
& money sufficient for the support of said minor one year from the time of the death
of her said father and that order Isue accordingly

commissioners to allot and set apart to Nancy E Widow of Wm H HARWELL dec'd so much of the
Crop Stock monies provisions &c sufficient for the support of herself and amily for
twelve months from the death of her said husband and that they report the same to the next
term of this Court Isued Sept 2, 1850

It appearing to the Court here that Jacob STRICKLIN late of said County is dead and have
made no last will and testament in writing and Thomas CHRISTIAN making application to have
letters testamentary granted to him upon and singular the goods & Chattles rights
& Credits of the said Jacob STRICKLIN dec'd and he having given bond and security as
is by law in such cases required it is ordered by the Court that he have letter
accordingly Where upon the said Thomas CHRISTIAN took the necessary oath for his
qualification
Ordered by the Court that David VOORHIES W B SKILLERN and G I WALKER freeholders be
appointed Commissioners to allot and set apart to Sarah Widow of Jacob STRICKLIN dec'd so
much of the Stock Crop provision & money as shall be sufficient for the support of

minor heirs of Mary W MONTAGUE dec'd was this day submitted to the Court which was
received and ordered to be recorded
Came James ARNETT Guardian of Alfred P Minor heir of Guston KINDEL dec'd and renewed his
bond in the sum of three hundred and sixty dollars with George W. BARKER his security

Be it remembered that his cause came on this day for further hearing when it appearing to
the Court that publication has been as to the non resident defendants in the cause as
required by a decretal[sic] order made at the last term of this Court and said defendants
having failed to plead answer or demura[sic] It is ordered by the Court that this cause as
to them be taken for confession and set for hearing esparte[sic]

Thomas A. POPE et als vs Lemuel J ANDREWS et als petition to sell land and divide slaves
Be it remembered that this cause came on this day for further hearing before the
worshipful David J JONES William LAFFERTY and James T YOUNG Justices of the peace for the
County of Wayne and State of Tennessee duly commissioned and qualified to hold the County
Court for said County then and there presiding and hold said Court upon petition order pro
confessor exhibits and proof When it appeared to the satisfaction of the Court that Lemuel
POPE died in said county of Wayne in January 1848 leaving and surviving him neither widow
or descendants but leaving and surviving him the petitioners and defendants his
distributes and heirs at law as mentioned and set for in the petition in this cause and
that they as such distributees and heirs at law are entitled to the land and slaves as
mentioned and so for in said petition and it further appearing to the Court from the proof
in the cause that the same be sold It is therefore ordered adjudged and decreed by the
Court that Samuel L. BURNS be appointed commissioner who after having given 30 days notice
in written advertisement at the Court House in Waynesboro, Ashland, Clifton and Sorby, in
said County shall proceed upon said land to sell the same upon a credit of one and two
years to the highest bidder that he take bonds from the purchase money with two or more
good and sufficient securities retaining a lien until the same is paid that he enter into
bond with two securities payable to the chairman of this court in the sum of six thousand
dollars conditioned for the faithful performance of this duties as such commissioner and
that he report to the next term of this Court.
It is further ordered & adjudged and decreed by the court that John McDOUGAL Jonathan
I BIFFLE Franklin WITHERSPOON David J JONES and John A BURNS or a majority of them be
appointed commissioners who after having been duly sworn for said purpose shall proceed to
value the slaves mentioned in the said petition to wit Daniel, Bandy, Ann, Crawford,
Calvin, Henry, Anthony, Wiley, Grundy, Melissa, Louisa, Ben , Sibba, Lutitia and John

and add their whole value together and shall then divide said slaves into nine lots making
each lot as near equal in value as can be and charging the lots greater in vale than the
one ninth part of the value of the whole number and with the excess over such average

William M LAFFERTY Esqr. Justices &c present and presiding upon the report of the
Commissioner theretofore appointed to lay of the dower of the petitioner out of the lands
of her deceased husband which said report is in the words and figures following to wit
[To the worshipful County Court - crossed out] The undersigned being unconnected with the
parties either by affinity or consanguinity and entirely disinterested having been
notified by the Surveyor for Wayne County have proceed to allot and set off to Catherine
MABERRY her Dower out of the real estate of Daniel MABERRY her deceased husband after
having duly consider and fully understood the whole matter do hereby assign to the said
Catherine MABERRY for her Dower the following described land with the exctions[?] and
improvements thereon to wit A tract of land in the County of Wayne on the waters of Beech
Creek containing seventy eight acres and bounded as follows Beginning on a Sycamore the so
west corner of entry No. 630 in the name of Daniel MABERRY for 77 acres runs south 40
poles to a chinguepin oak then South 10 (degrees) West 20 poles a small persimmon Chestnut
oak pointers then East 15 (degrees) So 112 poles to a beech then North crossing Beech
Creek at 26 poles in all 71 poles to a Hackberry then East 10 poles

to a a stake then North 15 (degrees) west 64 poles to a poplar then west 30 ( degrees)
North 23 poles then North 26 poles to a Red Oak then west 60 pole to a stake then South 80
pole to beginning Which in our opinion Judgment constitutes one third part in value of the
real estate of Daniel MABRY deceased died possessed of given under our hand this Febr. 22d

Which not being in any wise excepted to is in all things confirmed it is therefore ordered
adjudged and decreed by the Court that all the right title claim and interest of said
defendants in and to the above described tract of land be divested out of them for and
during the natural lifetime of said petitioner Catherine MABRY and that the same be vested
in the said Catherine MABRY for and during her natural life it is further ordered and
adjudged by the Court that said petitioner Catherine MABRY
pay the costs in this behalf expended and that execution issue

Be it remembered that this cause coming on this day for a final hearing before the

and George W BARKER Esqr Justices &c upon the report of the Commissioners heretofore
appointed to lay off to petitioner her Dower out of the lands of which her dec'd husband
died seized and possessed which report is in the words and figures following to wit
State of Tennessee Wayne County By order of the County court of Wayne County February Term
1851 We Jesse S ROSS Surveyor Joseph EAST & John R HELTON commissioners to allot and
set apart Mary N SHIELDS her dower our of the real estate of John N SHIELDS her deceased
husband after having understood the whole matter have proceeded to run and mark off 132
1/2 acres as her dower beginning at the So. West corner of James HELTONs 155 acres Entry
running South passing TURNERs So. East corner at 2 poles in all 25 poles to a small sweet
Gum then east 5 (degrees) south 20 poles to a large poplar then East 32 degrees South 32
poles to a Rock hickory and sweet gum pointer thence South 40 poles to a chestnut then
East 10 degrees South -? to a stake then North 110 poles to the S.B. of A.G. McDOUGALs
entry then West with McDOUGAL s & HELTONs S.B. 175 poles to beginning Including the
improvements dwelling houses lots &c being in our judgement one third in value of the
real estate of John N. SHIELDS deceased died seized and possessed of Given under our hands

State of Tennessee vs John L FOWLER Warrant for Bastardy
This day came the defendant by his attorney and by leave of the Court enters a motion to
quash the warrant in this case whereupon It is considered by the Court that said motion be
sustained and that said warrant be quashed and that the defendant be hereof discharged a
go hence it is further considered by the Court that the County of Wayne pay the cost of
the part of the State expended
Ordered by the Court that John F HALL be appointed overseer of the road of 1st class in
the place of John M BENHAM removed and that he have the hands in the same bounds to work
under his direction Isued Mar. 8th 1851
Where as at the Febr. term of this Court Thomas H MABRY Trustee of Wayne County reported
to the Court the Condition of the revenue of said County which was received by the Court
and ordered to be recorded And whereas said report does not appear on the minutes of said
Court it is therefore ordered by the Court that it now be recorded as for then
Ordered by the Court that the following good and lawful men of the County of Wayne be
appointed and summoned by the Sheriff of Wayne County to be and attend at the next term of
the Circuit Court to be held for the County of Wayne at the court house in the town of
Waynesboro on the fourth Monday in May next To wit, Isham TURNBOUGH William BOWDEN William

Ordered by the Court that he sheriff of Wayne County summons and qualify a Jury not to
consist of not less than five or more than twelve free holders to view and mark out so as
to chage[sic] the road of 2d Class running from Ashland down Buffalo to commence at 48
mile Creek ___? by L G RASBERRY and intersect the old road at some suitable point and that
they report the same at the next term of this court Isued Mar. 8, 1851
